    List of executive actions Obama plans to take as part of anti-gun violence plan

    The following is a list, provided by the White House, of executive actions President Obama plans to take to address gun violence.

    1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.
    2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.
    3. Improve incentives for states to share information with the background check system.
    4. Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.
    5. Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.
    6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.
    7. Launch a national safe and responsible gun ownership campaign.
    8. Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).
    9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.
    10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.
    11. Nominate an ATF director.
    12. Provide law enforcement, first responders, and school officials with proper training for active shooter situations.
    13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime.
    14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.
    15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies.
    16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.
    17. Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.
    18. Provide incentives for schools to hire school resource officers.
    19. Develop model emergency response plans for schools, houses of worship and institutions of higher education.
    20. Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.
    21. Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.
    22. Commit to finalizing mental health parity regulations.
    23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.

      If Boehner would have just pants the fellow instead of sitting there looking blank, he would have made the point about infringing on his freedom of movement, ”shall not be infringed” may have been made relevnt.

        Feedback from Ronald Nelson on the Post ” Obama & Biden Declare War on 2nd Amendment;
        Ordering federal agencies’ to ignore present Federal Statutes that PROTECT a citizens right to privacy is beyond the Presidents powers… it takes legislation. Such an order is an illegal order and if funds are expended to enforce such an order… it would constitute misappropriation of government funds… a high crime.

        Making otherwise restricted information available for background checks: medical records, documents or records that are private and the disclosure of which violate client privilege rights (with medical and mental health professionals) requires LEGISLATION. The President doesn’t have the authority to order Doctors, mental health officials, and Federal agencies to VIOLATE existing Federal law… PERIOD.

        ( name redacted)if you can not see the error in his issuing such orders… then you are intentionally looking the other way. There is a correct way to address many of the issues the President has concerns over… most, require LEGISLATIVE AUTHORIZATION.

        Orders or regulations which INFRINGE on the right of citizens to keep and bare arms… including, the restriction on INTEGRAL components, associated with being armed, historically include magazines, sights, scopes, etc. It is an ’infringement’ upon one’s 2d Amendment right to keep and bear arms, if one limits an integral component of an Armament. Placing a restriction on the number of rounds and or the configuration of an armament (calling it an assault weapon does not change the fact it is an armament)… is a restriction and infringement of ones Second Amendment right.

        Most, existing gun laws are in fact unconstitutional… as they clearly infringe upon the rights of citizens to ’keep and bear’ arms… as rendered by the simple and direct language used in the Second Amendment. If the President wants to regulate arms: to in effect, infringe upon a citizens right to keep and bear them. Then he must FIRST AMEND the CONSTITUTION. Once the Constitution is properly amended to allow the Federal Government to ’infringe’ upon a citizens right to ’keep and bear Arms’; then, Congress must legislate gun control laws. Once, Constitutional gun control legislation is signed into law; then, the President may issue Executive Orders to clarify and enforce those law, all within the intent of Congress…. not by his edict or recommendation of a committee.

        There exist no current statutory authority for the president to require NCI checks for ’private sales’ of fire arms. Issuing an Executive order that requires federal agencies too implement programs that are aimed at mandating NCI background checks for all private sales is illegal… and the funds used to do so would constitute ’misappropriation of government funds’… a high crime.

        There are no existing laws or Federal Statutory authority requiring ALL gun and ammo sales… to have NCI Checks. Any order or action to impose such a requirement would be illegal and any funds spent too enforce such an action would constitute misappropriation of government funds… a high crime.

        Do you think it proper for a President to misappropriate government funds… to make expenditures without Congressional or Statutory authority?
