Tea Party Patriots to Supreme Court: Please save America

Next week, the U.S. Supreme Court will hear oral arguments on the constitutionally of ObamaCare. The arguments presented to the court will be complex and the questions posed by the jurists will be dissected and analyzed. However, the question posed by most Americans will be simple — will the court radically change our government and redefine our status as citizens? Millions of Tea Party Patriots believe it will, and we are begging the court to reject this law and save America.
This is not a case of political hyperbole. ObamaCare is quickly becoming a complex labyrinth of bureaus, boards, councils, committees, taxes and control agents — each designed to entrap every American in a cycle of health care dependency and hopelessness. The Soviet Union collapsed in part from its reliance on government central planning; but for some reason, President Obama believes he can do it better. The tea party does not share his unsupportable optimism.
A Supreme Court decision upholding the individual mandate portion of the law will almost certainly place Americans far down the “road to serfdom” that economist Friedrich Hayek warned of in 1944….Read More….

Wish I could be there. So proud to see Americans that love their country,( not for the first time) show how to conduct a civil demonstration , not orchestrated like the entitlement drones of this communist government ( occupy wall street leaches)
While I agree that the occupy wall street thing was done in poor taste in many ways (at least in my town where I went and talked to a bunch), they were there protesting the “entitlement culture” in this country. They just happen to think that it is the entitlement culture of the mega-rich and multi-national corporations and banks that is hurting this country the most. True there is welfare fraud and medicaid fraud and a whole slew of ways in which people scam the system. But those are chump change compared to the BS entitlements the big banks get. I am talking about the trillions and trillions of dollars that the banks had given to them, in effect subsidizing their fraudulent, criminal behavior. So maybe its just me but I hate being taxed, but Id rather it go to help some person eat than someone buy their third yaht. Also if you look at the total money spent by the gov in a year on the bottom %20 (welfare, food stamps etc) it is not much compared to the corpoeate welfare system.
Just because some FEELS that health care is a “right” doesn’t make it so. No guarantee’s in life, so let’s just drop the government programs. What ever happened to people taking care of themselves, make a plan for you life and stick to it, if you screw it up, fix it and move forward. I’m not paying for parasites anymore!!!!!

I do know and remember that President Obama said we would be saving under his health plan and yet rates still rise at a phenomenal rate. With the increase in gas, health providers, hospitals, doctors cost of doing business, etc etc all go up along with energy increases. EVERYTHING rises in price. It will be a vicious cycle that will destroy us for sure. Something must be done soon or perhaps we may not even make it to the next Presidential election. Help!!
You are right that insurance rates are rising crazy fast. But they were doing that long before this bill was passed. Remember many of its provisions are not even taknig effect yet. The real problem is that most people have very few choices of insurance providers. This means that there is very limited competition in prices, so the companies can consistently raise their rates. I mean where else will you go? It is interesting when you see reports on the percentage of insurance premiums that customers pay that do not go to health care. Remeber a large chunck of every insurance bill you pay goes to executive bonus’, shareholder profits and into advertisments to compete with other companies. Also remember that these exec bonus’ and share holder profits are (and have been) at extremely high numbers. It is not uncommon to hear that Blue Shield execs made record bonus’ in a given year, even though their customers rates happened to go up that year “because of increased medical costs”. Hmmmm maybe those costs are going up, but why do we have to pay for really rich peoples raises on top of the increased medical costs?
I don’t want a panel of 15 people who are not doctors telling my doctor how and when I will be treated! This whole thing is a big fiasco just like sheep being led to the slaughter
Derek you are right about many things, but problem solving involves being able to prioritiez and identify the correct problem. You have heard for years the possible solution of allowing insurance companies to go across State Lines. The creation of pools etc. yet never one bill to try and correct one problem. The prior blogger also mentioned the increases in energy bills. Thos of us older, remember and still have records of our energy bills in 1980 and late 70′s with the last big crisis. Yet, the big mantra and environmental excuse of not in my back yard continued to be a priority and bigger lobby than those who questioned science and global cooling and than global warming, and energy bills continued to rise no matter what steps individuals took to cut costs. It is all peoples basic needs that must be the priority for any nation, and the responsibility of every individual to work to support their family and pay taxes. Without basic problem identification, research and the ability to review and amend immediately those entitlements and ideologies that increase dependence without solving problems or that increase dependency, law becomes the problem rather than the solution.
Our elected leaders aren’t certified in anything that pertains to basic math or reading, and with the reading statistics of the 70′s, 80′s etc, one has to wonder at the competence of many college graduates who go to congress without basic economic, reading or writing tools that are the basis of understanding and knowledge. When the lawmakers aren’t writing the law, arent reading the law or can’t understand the details until someone else (the civil service employees) writes and interprets the regulations, we have got a problem that needs to be solved. Maybe a test of candidates called 3R’s? Reading, writing and rithmatic? When that was the goal of basic education, the U.S. was tops in the world in education. Could it be the slippery slope has become the bottom of the heap and we are it.?

How true. They just unloaded $55 trillion of crappy, sub-prime investments onto the FDIC like they were real dollars. So now whenever one of those sub-prime loans goes bad the tax payers are on the hook. Considering BofA had some of the worst lending standards and some of the most reckless investing practices just a few short years ago when the market crashed, Id bet a bunch of the $55 trillion will too. So I know everybody is mad at Obamacare and that damn EPA, but neither of these even scrapes the surface of the amount of damage that the giant banks did and continue to do on our country and future. And just as a side note I did not vote for Obama and I will not in 2012, Im not even a democrat. Personally I feel that BOTH parties are bought and paid for.

I attended The Stand Up For Religious Freedom Rally yesterday in San Diego. I realize this is just part of the whole issue but it was a very good event with a good turnout. More and more people are waking up the Obama’s takeover of our health care. I think getting the clergy involved in this issue is a very important.
Can I ask you guys and gals one thing? My aunt had the same health insurance for over ten years when she got cancer. Then her insurance company told her that it was a pre-existing condition (wink wink) that I guess she had for over a decade. So she had to wipe out her and her husband’s retirment so she could live. Now my understanding is that this new health care law will stop things like that from happening. So my question is, how is that a bad thing?
Many people forget the so-called summit the President had with Republicans in which there was a great exchange of ideas. I don’t know the facts of your aunt’s case, but those are situations that should be addressed no matter what system is in place.

Until you truly understand the root of his reponses, you will not understand how this is bad for everyone. Remember this is a man with nothing to gain politically, unlike those that passed it. Not everyone is faced with your aunt’s situation and I’m sorry that happened, but you don’t rip a system apart because there are some problems in certain areas. You also do not directly contradict the contract laws we have on the books which states that noone shall be forced into a contract under duress. Beyond the individual mandate, there are so many other issues. The employer mandate is the one that frightens me the most. It is a fact that many people will lose this type of coverage as employers will be faced with either paying penalties and fines or meeting these newly mandated requirements. Many of them will not be able to afford the new mandated requirements and will be forced to funnel employees into these state-run healthcare exchanges. There are medical professionals I know that are certain we are heading towards a single-payer system. Is this what you want for your country? I do agree that preexisting conditions should be addressed and that noone should go bankrupt trying to stay alive. There are answers on how we can achieve this. The Unaffordable Healthcare Act is not one of them.

The simple passage of a singular law to prevent that scenario would have been sufficient. A better question to ask is; Why haven’t they, and instead seek to invoke a system that will eventually become ponderous and unwieldy and make your medical choices for you. You know darn well its going to eventually come down to price and practicality. The problem is, you just wont know its happening, nor know that you’re a victim of it. I’ll tell you the truth, you’re already a victim and you don’t know it, thanks to the pharmaceutical industry and their favorite watchdog, the FDA along with the AMA, medical journals, and the ad industry as a whole. There are already cures for cancer. You are right about the corporate greed problem, but that corporate greed/welfare loop goes deeper than you know. Don’t believe anyone that suggest that the medical industry is not in favor of a gov’t run healthcare system. They are – especially big-pharma. The best friend of big business is big gov’t. And they’re going to harvest you like a cash-crop field even more than they already are, keeping you subtly unhealthy and strung out on endless drugs and useless, even dangerous treatments. You just won’t know its happening, that’s all, because they’ll control what you know (as they already do). That’s the blue pill. I’m alt-med as you can tell. With the call for the repeal of “Obama Care” and in particular the tyrannical individual mandate provision, it would be prudent to note that this was initially a Republican proposed and led initiative.

Categories like 39th in infant mortality, 43rd for adult female mortality, 42nd for adult male mortality, and 36th for life expectancy, obesity, cancer, heart disease etc.
If “Obama Care” is repealed whose interests are really being served, certainly not those of the American people. The For-profit health care business that exists here in the US has long since failed the American people.

Health care should be considered one of the most important fundamental rights citizens of any nation can hold. Without health there can be no life, without health there can be no liberty, and without health there can be no pursuit of happiness.

I would agree with a gov’t sponsored health care system for people who can’t afford insurance and want to join it voluntarily, but not one that forces participation on everyone. Just because the gov takes over doesn’t mean that medicine will be cheaper. The med industry will get their cut – believe me. All you’ll see is your taxes going up and up. A while ago, I looked at some of the claims of those who prop up the superiority of other countries. Those people are generally paying anywhere from 50 to 70 percent of their pay to their gov. You’re going to pay for it one way, or another. Also, the claim pushers have, in the past, included millions of illegal aliens into their equations and probably are still. And, to make mortality comparisons with other countries like Sweden, as you have done so below, is far too simplistic. Its very intertwined and complicated. The stats at the CIA, FBI and UN don’t jive with the NEJM. All social ills are on the rise in those countries, in spite of the heavy taxation they bear to solve it. Drug abuse, rape, robbery and many other ills are rampant. Yet, they have a near negative growth rate. By contrast, the US has a normal immigration rate nearly twice that of the entire population of Sweden. That make a huge impact on the equations and produces appearances, like flawed Gini coefficients, that may be more convenient than reliable. And to your last statement, do you really want the gov to be in charge of administering your life, liberty and pursuit of happiness ? You trust them that much ? Are you old ? On SS ? The collusion of government and selected enterprises causes those problems, not the free market. Less government and more voluntary governance is the solution.
A few well places laws, that’s all that’s needed. But much of those 50 million are illegal immigrants, not your brothers and sisters. Are you wanting to give them free health care also ? Because you know its eventually going to come down to half of your paycheck. I’m not trying to sound callous or selfish, but I don’t think we can handle it. Its already a huge problem.
Also, though off topic, one could as well clip out an idealistic blurb from the Carl Marx manifesto that sounds just as noble as Thomas Pain. Pain was so heavily criticized by his peers for his atheistic sermonizing that he eventually had to leave Washington. Upon his death, no cemetery would even accept his body.

It is hard to ignore that in 2006, the United States was number 1 in terms of health care spending per capita but ranked 39th for infant mortality, 43rd for adult female mortality, 42nd for adult male mortality, and 36th for life expectancy. These facts have fueled a question now being discussed in academic circles, as well as by government and the public: Why do we spend so much to get so little?
In 1974, mortality among boys and men 15 to 60 years of age was nearly the same in Australia and the United States and was one third lower in Sweden. Every year since 1974, the rate of death decreased more in Australia than it did in the United States, and in 2006, Australia’s rate dipped lower than Sweden’s and was 40% lower than the U.S. rate.This comparison makes clear that U.S. performance not only is poor at any given moment but also is improving much more slowly than that of other countries over time.
The current proposals for U.S. health care reform focus mostly on extending insurance coverage, decreasing the growth of costs through improved efficiency, and expanding prevention and wellness programs. The policy debate has been overwhelmingly centered on the first two of these elements. Achieving universal insurance coverage in the United States would protect households against undue financial burdens at the same time that it was saving an estimated 18,000 to 44,000 lives.4,5 However, narrowing the gap in health outcomes between the United States and other high-income countries or even slowing its descent in the rankings would require much more than insurance expansion. Given the vast number of preventable deaths associated with smoking (465,000 per year), hypertension (395,000), obesity (216,000), physical inactivity (191,000), high blood glucose levels (190,000), high levels of low-density lipoprotein cholesterol (113,000), and other dietary risk factors, there are huge opportunities to enact policies that could make a substantial difference in health system performance — and in the population’s health.4 More investments that are targeted at promoting proven strategies could dramatically reduce mortality and enhance the performance of the U.S. health care system.

My brother, David, suffered from severe bi-polar disorder and depression for many years. As a result, he was unable to work and had no health insurance or money. For years, he begged for help from almost every psychiatrist and community health center in Oklahoma City. Not surprisingly, he was turned away each every time because he had no money or insurance. On November, 4, 1997, he finally stuck an AK47 in his mouth and pulled the trigger. I tell people that you can’t really appreciate the value of health care until you’ve cleaned brain matter off the wall with a sponge and picked up teeth and skull fragments off the floor. Interestingly enough, the right to own and gun and to subsequently blow your brains out is guaranteed in the constitution. The right to health care and to stay alive is not. To quote a well worn Republican phrase – when are the chronically sick and disabled deserving of their “right to life”?
Our Declaration of Independence and the Constitution of the United States promises you, as an individual citizen who has pledged your allegiance to support and abide by said documents, to have a right to expect that government will not impede upon or abridge your right to life, liberty and your pursuit of happiness; nothing more.

Freedom is NOT spelled Government Takeover. Obama’s claim to fame is that of a teacher of the Constitution, surely Obama knew that ObamaCare is unconstitutional. Obama, Reid, Pelosi wasted time, take payer money on this bill. The time should have been spent on JOBS, energy independence, housing market and important issues that threaten our country.

We’re not being selfish, the government is! They want full power over us and that is what this is about. If we used the free market, voluntary commerce associations (conducting transactions only with businesses that deposit money into a citizen controlled trust fund to pay for things like this), and legalized alternative care then we would be able to help a lot of people.
The RIGHT to healthcare, insofar as it is defined in terms of the Endowment of an inalienable right by our Creator, is in your individual capacity to provide it for yourself. Anything more than this is NOT a RIGHT.
Everyone has good points to every problem but obamacare is there for people who cant afford health care but we the people have free choice and it takes our free choice and that is not what we want, but with banks and money. That is where two of our presidents both failed at keeping the people’s interest in money and healthcare but when I have kids, then turn old I wont have what seniors have now. No one told me till I was 22 years old that I need to think about working on my retirement and thanks for congress for messing it up.
Here is an idea: Get insurance companies out of the healthcare industry. Insurance is what causes the inflation of healthcare. Take insurance out of the mix and watch prices go down and services. You want to force doctors and hospitals to truly compete? Get the insurance companies out of the business of healthcare. Think about it!

Can the Supreme Court make rulings that are unconstitutional?
While this question appears on the surface to be an oxymoron, it is in fact possible and has happened previously.
Our founding fathers set up principles that are supposed to set limits on each branch of government that would make it difficult or impossible for one branch to run the government in any way they see fit. For it to work properly each branch must exercise its authority under the Constitution. If one branch attempts to exercise powers not granted to them by the constitution the other branches must step in put a stop to it. If they do not, we end up with a constitution that means nothing and a dictatorship.
The Supreme Court’s powers are limited to making decisions based on the confines placed on them by the Constitution. If they make rulings based on their political or personal bias they violate their oath of office and damage the reputation of the court.
As Chief Justice Marshal said,

I do solemnly swear that I will administer justice without respect to persons, and do equal right to the poor and to the rich; and that I will faithfully and impartially discharge all the duties incumbent on me as according to the best of my abilities and understanding, agreeably to the constitution, and laws of the United States.
Why does a judge swear to discharge his duties agreeably to the constitution of the United States, if that Constitution forms no rule for his government? If it is closed upon him, and cannot be inspected by him?
If such be the real state of things, this is worse than solemn mockery. To prescribe, or to take this oath, becomes equally a crime.
Thus, the particular phraseology of the Constitution of the United States confirms and strengthens the principle, supposed to be essential to all written constitutions, that a law repugnant to the constitution is void; and that courts, as well as other departments, are bound by that instrument.”
A recent example of a perversion of the Constitution is the ruling regarding eminent domain that stated a private entity can take your property by order of the court if they can pay more taxes than you.
Fifth Amendment:
“No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”
Kelo v. City of New London, 545 U.S. 469 (2005) was a case decided by the Supreme Court of the United States involving the use of eminent domain to transfer land from one private owner to another to further economic development. The case arose from the condemnation by New London, Connecticut, of privately owned real property so that it could be used as part of a comprehensive redevelopment plan which promised 3,169 new jobs and $1.2 million a year in tax revenues. The Court held in a 5–4 decision that the general benefits a community enjoyed from economic growth qualified such redevelopment plans as a permissible “public use” under the Takings Clause of the Fifth Amendment.
The city eventually agreed to move Susette Kelo’s house to a new location and to pay substantial additional compensation to other homeowners. The redeveloper was unable to obtain financing and abandoned the redevelopment project, leaving the land as an empty lot, which was eventually turned into a dump by the city.
On June 25, 2005, Justice Sandra Day O’Connor wrote the principal dissent, joined by Chief Justice William Rehnquist, Justice Antonin Scalia and Justice Clarence Thomas. The dissenting opinion suggested that the use of this taking power in a reverse Robin Hood fashion— take from the poor, give to the rich— would become the norm, not the exception:
“Any property may now be taken for the benefit of another private party, but the fallout from this decision will not be random. The beneficiaries are likely to be those citizens with disproportionate influence and power in the political process, including large corporations and development firms.”
She argued that the decision eliminates “any distinction between private and public use of property — and thereby effectively delete[s] the words ‘for public use’ from the Takings Clause of the Fifth Amendment.” 125 S.Ct. 2655, 2671
Clarence Thomas also penned a separate originalist dissent, in which he argued that the precedents the court’s decision relied upon were flawed and that “something has gone seriously awry with this Court’s interpretation of the Constitution.” He accuses the majority of replacing the Fifth Amendment’s “Public Use” clause with a very different “public purpose” test: “This deferential shift in phraseology enables the Court to hold, against all common sense, that a costly urban-renewal project whose stated purpose is a vague promise of new jobs and increased tax revenue, but which is also suspiciously agreeable to the Pfizer Corporation, is for a ‘public use.’
Justice can be sweet as the final cost to the city and state for the purchase and bulldozing of the formerly privately held property was a reported $78 million.
You did not have be a graduate of Harvard Law to understand that the Supreme Court over stepped its bounds and violated the Constitution. Four members of the Supreme Court disregarded the plain language of the Constitution and decided to expand government power beyond that which was permitted under the law. No one is required to obey an unlawful order. The legislature should have stopped any attempt to enforce this order. No common sense here!
The Court’s first decision declaring Executive Branch action to be unconstitutional, Little v Barreme (1804), called the Flying Fish case, involved an order by President John Adams, issued in 1799 during our brief war with France, authorizing the Navy to seize ships bound for French ports. The president’s order was inconsistent with an act of Congress declaring the government to have no such authorization. After a Navy Captain in December 1799 seized the Danish vessel, the Flying Fish, pursuant to Adams’s order, the owners of the ship sued the captain for trespass in U. S. maritime court. On appeal, C. J. Marshall rejected the captain’s argument that he could not be sued because he was just following presidential orders. The Court noted that commanders “act at their own peril” when they obey invalid orders–and the president’s order was outside of his powers, given the congressional action. The court should also recognize that should its rulings be judged unconstitutional by the legislature, no one is bound by its decisions. There is a two way street here. No judge is above the Constitution!
If Obama wins reelection it appears that he will have the opportunity to appoint two additional members of the Supreme Court. This could well prove to be the straw that breaks the back of our Republic. It is clear that Obama and his minions have intent to push this country and our society into a form of government not based on the Constitution or with coequal branches of government.
It is said, power corrupts and absolute power corrupts absolutely. Sadly, the political elite has been in power so long that corruption has become the norm rather than the exception.
All governments stay in power based on the will of the people. History clearly shows us that governments can by force (passive or active) render the people’s will ineffective but over time the people will no longer tolerate oppression and rise up and take back their basic rights.
Presidential candidate Newt Gingrich is reported to have said, that the U.S. does not have to “tolerate radical, anti-American judges rewriting the American Constitution.”

The Supreme Court will act as it wants to- really with no regard to the law-as they believe that what they say IS the law-and that is all there is to it from their point of view,which is essentially egocentric.They really dont care about winners and losers and the effect their decisions have on the ‘losers’ particularly .Their decisions will always ensure THEY(the justices)are the winners..If Obamacare does get going,the only way to ‘beat’ it is to start alternative program or programs where this is possible at local levels,perhaps through charities or other suitable tax-exempt structures. People who dont trust Government (why would anyone?) would flock to such services.I wont tell you this would be easy and it might be like trying to dry oneself with a wet towel but it is the individuals only chance.To beat ‘the system’ one must first get outside of it. There may be some casualities but these will just have to be coped with.Sorry to paint a gloomy picture, but better to face reality than find out the truth with ‘no time left to start again’(apologies to Don McLean-’American Pie’.
