Thank you for contacting me regarding your views on the tax-exempt status of 501(c)(4) organizations. I appreciate hearing from you on this important issue.

I attended a hearing of the Senate Finance Committee on May 21, 2013, to examine the criteria used by the IRS to identify tax-exempt organizations, and in particular, 501(c)(4) applications, for greater scrutiny. During the hearing, I questioned the acting head of the Internal Revenue Service to provide clarity on the regulations regarding non-profit entities.

I believe we need a clear system in place to protect against the targeting of organizations based on political, religious or other social affiliation. This is a serious issue and this type of targeting will not be tolerated. I will also continue to work to clarify rules around 501(c)(4) status.

According to a Department of the Treasury Inspector General report, between 2010 and 2012, career employees at the Cincinnati office of the Internal Revenue Service referred applications of organizations applying for 501(c)(4) status for additional scrutiny if certain words were used by the organization on its application. On May 10, 2013, the IRS issued a statement stating the process used by the employees in Cincinnati office to review applications was an inappropriate practice. The IRS also stated the process was corrected in the summer of 2012 after an internal review. On May 14, 2013, Attorney General Eric Holder announced the Department of Justice would begin an investigation into the IRS's process for reviewing applications for tax-exempt status.

Tax-exempt organizations provide valuable services to society and they are expected to meet strict standards in order to maintain their exempt status. It is important that Congress, especially the Senate Finance Committee, of which I am a member, continues to provide oversight of the Internal Revenue Service to ensure employees are following the intent of the law and applying the law appropriately. It is also important to continue oversight of these tax-exempt groups in order to ensure that they are operating in a manner that justifies their tax exemption.

Social welfare organizations are eligible for tax-exempt status under Section 501(c)(4) of the Internal Revenue Code. 501(c)(4) organizations must operate for the primary purpose of bringing about civic betterment and social improvements. As social welfare organizations, they are permitted to engage in political campaigning, though it cannot be the organization's primary activity. While they are not required to submit an application to the Internal Revenue Service (IRS) to receive tax-exempt status, they are required to file an annual information return with the IRS; however, information as to who donates to the organization remains private.

I had met him before at the 2 TPP conferences in 2012 but many of our local Coordinators had not yet met him. We got a 2 hour overview of his The Making of America!! We will be discussing when to bring him to the Seattle/Everett area and somewhere between Tacoma & Lewis County as we want to attract as many from W WA as possible. We have been having Coordinator Con Calls on the 1st Tuesday of the month. It is our goal to bring as many of us together on these calls as possible and it would be our pleasure to have you! Please contact me. I along with many of the local coordinators here in W WA are working to clean up the WA State group list and their coordinators. We are committed to getting a list that all the coordinators can have access to so that we may be better connected and support one another!

I appreciate you time! It is a long and involved task to accomplish this but once completed we are hoping to host a Wa State conference the end of the summer so that we can all meet one another and be a better force in the coming battles in Wa for Constitutional Conservative Libertarian successes!
