The biggest reason you need to call your Senators today
CALL THE SENATE NOW
Throughout the country, Tea Party activists and others are calling their Senators to tell them to vote against the Manchin-Toomey gun bill going through Congress. Many groups are focusing on the substance of the legislation – much of which is unknown right now – while Tea Party Patriots and others are focused on the non-transparent, rushed process the bill has gone through.
However, there is another, more basic, more important reason to make certain your Senators oppose Manchin-Toomey: the very simple fact that any legislation impeding the ability to own a gun is in violation of the Constitution. Only amendments to the Constitution can change it, yet this basic fact is often ignored.
It is unknown what the final bill in the Senate will look like, but let’s remind Congress of the basic constitutional protections their bill is likely to violate:
First, the Second Amendment says “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.”
Thus, even the most minimalistic bill that may pass, which aims to “expand background checks on firearm purchases and close the so-called gun show loophole,” violates the Constitution.
Second, the Supreme Court’s 2008 and 2010 Heller and Chicago cases clarified important points of the Second Amendment. In short, both cases set the standard that limiting the right to own a weapon for reasons of self-defense shall not be infringed either at the state or federal level.
Should the Manchin-Toomey legislation push its way through the Senate, it will yet be further evidence that Congress does not respect the Constitution, our nation’s foremost legal document. It will be further evidence that we live in a nation controlled by entrenched interests, not the people, and that our representative republic is no longer any such thing.
Rushed legislation, a non-transparent debate and discussion process, and violations of the Constitution – the unfortunate norm in Washington. Make sure your Senators do not follow this immoral and illegal practice by calling them today.
