Obamacare’s taxes are becoming clearer

Last evening, Reuters reported that the IRS has finished and released new rules on some of the taxes in the Affordable Care Act. The rules, released late last Friday, go into effect in the New Year, though they are considered “proposed rules” until April, until which public comment will be received:
The Internal Revenue Service has released new rules for investment income taxes on capital gains and dividends earned by high-income individuals that passed Congress as part of the 2010 healthcare reform law.
The 3.8 percent surtax on investment income, meant to help pay for healthcare, goes into effect in 2013. It is the first surtax to be applied to capital gains and dividend income.
The tax affects only individuals with more than $200,000 in modified adjusted gross income (MAGI), and married couples filing jointly with more than $250,000 of MAGI.
The tax applies to a broad range of investment securities ranging from stocks and bonds to commodity securities and specialized derivatives.
The 159 pages of rules spell out when the tax applies to trusts and annuities, as well as to individual securities traders.
Released late on Friday, the new regulations include a 0.9 percent healthcare tax on wages for high-income individuals.
Of course, nothing is ever truly clear with the IRS, even with a tax this expensive:
Together, the two taxes are estimated to raise $317.7 billion over 10 years, according to a Joint Committee on Taxation analysis released in June.
To illustrate when the tax applies, the IRS offered an example of a taxpayer filing as a single individual who makes $180,000 in wage income plus $90,000 from investment income. The individual’s modified adjusted gross income is $270,000.
The 3.8 percent tax applies to the $70,000, and the individual would pay $2,660 in surtaxes, the IRS said.
The IRS plans to release a new form for taxpayers to fill out for this tax when filing 2013 returns.
The new rules leave some questions unanswered, tax experts said. It was unclear how rental income will be treated under the new rules, said Michael Grace, managing director at Milbank, Tweed, Hadley & McCloy LLP law firm in Washington.
“The proposed regulations surely will increase tax compliance burdens for individuals,” said Grace, a former IRS official. “There’s clearly some drafting left to be done.”
Taxes, spending and the loss of individual choice. These are the consequences of the President’s health care law. Fortunately, this particular tax still has a chance of being overturned if opposition in the public comments is strong enough. We’ll try to keep updated on this, and provide a link to where public comment is taking place. For now, keep an eye on the Federal Register (found here) tomorrow, when the proposed rules are posted.

There is other clarification needed.
This is a gargantuan expense. Who, specifically, will be the recipients?
What qualifies a person to be a recipient of the benefits of this act?
And, another thing needs to be clarified.
Because the penalty paid has been declared not a penalty, but a “tax” (I think the Supreme Court needs a dictionary), who will pay this tax?
If 47 percent of American households are so “poor” they can’t afford to pay income tax, does the IRS expect them to pay the Obama tax? Or, will the other half of the population that pays the individual income taxes for everyone in the country have to pay their Obama taxes for everyone in the country as well as their income taxes?
What the entitlement followers don’t know yet, is that their “fine” for failing to purchase the mandated coverage is the dollar amount of their tax refund….most receive several thousand a year a tax time.

DB – Unfortunately, we already pay for people without insurance in the form of Medicaid. I for one supported the idea of everyone taking responsibility for for their own healthcare. It was a good idea under the Republicans in the 80′s and it’s a good idea now. Sadly, it should have been the Republicans saying this not the Democrats. If you go back, Obama was originally against mandated healthcare.
My personal experience, I work with a few guys who don’t purchase insurance for their families under our company’s insurance. One of the guys just had a baby. I asked him how much it cost him to have the baby. He said basically nothing because Medicaid paid for the costs. They even got free formula and diapers too! Sadly, he is a lifelong Republican and is against Obamacare.

I interpret this to infer he has an average annual income, assuming he does not have an engineering or science degree. Being responsible and reliable, having a family that he lives and works for, then choosing not to cover his family under the company-provided insurance doesn’t seem like the normal case for such a person.

In short, your description of the person assumes a lot implied about the beneficial character of them. That is inconsistent with choosing to not participate in an insurance plan provided by the company while the majority of people working at his same level participates. Then you force an emotional conclusion on the reader.

As for the father, he would rather lease a new car every 5 yrs than buy health insurance for his family.
Your company must pay poorly or the guy have more kids than he can afford on your company’s salary. Medicaid is means tested.
i have heard that tired statement “we pay for people on medicaid anyway” so why not have a government take over of all healthcare. the point is not for government to take over, but for government to get out of the way. allow the free market to work where competition will reduce the cost of healthcare and people of all incomes can purchase health insurance as you do with life or auto. second, clean up the fraud on the medicaid rolls. we probably spend billions on people who should not be on it in the first place, like illegals. third, do people really believe that healthcare costs will be lower by this law. if you do, i have a bridge i would like to sell you. prior to medicare in the 60′s, most people did not have health insurance and health care was very affordable. you went to the dr. and paid the 10/20$ for the visit. needed tonsils out, the drs. had a payment plan. once tax dollars became involved the tax dollar floodgate opened. government is not the answer, it is a big problem and it will be getting worse. tell me one program the government runs that isn’t operting in the red. besides, the country is broke. remember, we are 16 trillion in debt.

You said a mouthful there! If the government would butt out and stop meddling where they have no idea what they are doing, the American public could get this mess fixed. Afforable Health Care is good enough for those of us who a lowly citizens but not good enough for members of Congress and, most of all, Obama and his family! What is wrong with this picture? This new Health Care (Obamacare) law requires an RFID chip implanted in all of us. This chip will not only contain your personal information with tracking capability but it will also be linked to your bank account. And get this, Page 1004 of the new law (dictating the timing of this chip), reads, and I quote: “Not later than 36 months after the date of the enactment”. On Sunday March 21, 2010 the Senate Healthcare bill HR3200 was passed and signed into law the following Tuesday.
Page 1004 of the new law (dictating the timing of this chip), reads, and I quote: “Not later than 36 months after the date of the enactment”

Sorry to inform some of you that many of us don’t pay annual taxes because we don’t have “taxable income”; we simply don’t make enough money to pay more than we do during our work year. Oh, we pay alright, you seem to forget that federal, state, and, in some places, local taxes are deducted each paycheck. We also pay sales tax on everything from groceries to lawnmowers, even prescriptions. Let’s not forget the property taxes that are an annual burden for homeowners.
As for buying my own healthcare, I have a problem because I can’t afford the monthly premiums. Seriously. I would love to have health insurance, it’s no small thing to be running up doctors bills. I’m in my 50′s, reasonably healthy, work part-time, and my husband is on disability. I checked a government website to get an idea of what this Obamacare “affordable plan” is going to cost for me. My affordable healthcare plan will run me $348 in premiums every month. If I had that much money each month, I’d be insured for my healthcare already. So please don’t assume that all people who aren’t insured prefer not to take responsibility for themselves.

What happens when there are no more people that make 200000 a year? Because that will be the end result. What will happen when people lose there job because the 200000ers cannot afford this? Because that will be the end result. Kind of like gravity. If you throw it up in the air, it has to come down. Its a natural law of the earth. If I overspend, and keep on overspending, will someone bail me out? Pretty soon, there will be no money to bail me out. This is what Obama is doing and some people have their glorified blinders with this man. And that is what he is, a man.

That is just not true. Clinton had a tax and spend plan and we ended up with the strongest economy in decades. We will always be a capitalist country. There will always be money to be made. Just because the rich is going to be taxed more than the middle class is not the end. The sky won’t fall and life will go on just like it has. I still don’t understand why this group supports the ultra rich and corporations? Why would you support Corporations that put small business men out? Can someone explain that to me?
What I love most about this site is reading the same individuals telling the TEA Party how irrelevent they are, or that the idea of limited government is such a failed concept. Here’s an interesting health care observation. After reading the observation, the questions are:
1) What oversight currently exists?
2) What in ObamaKare will fix this?
3) What does the Surgeon really do for a living?
I had a case of food poinoning and spent 2 hours in an emergency room. The first treatment consisted of having sensors placed at various locations on my torso and recordings made for analysis, then the analysis. Time consumed, about a half hour. Conclusion, I was not having a heart attack. Then, I was given a sonogram looking for gall stones. Time consumed, about a half hour. Conclusioin, inconclusive.
I was given an injection to relieve the discomfort, which caused me to regurgitate the poisonous food.
The total time spent in the ER was approximately 2 hours.
The hospital billed my insurance company over 8 thousand dollars.

From what I can tell, there is nothing in ObamaKare that will have an impact on this. It appears the government will determine what is paid, like it determines things like a simple wrench or a toilet seat costs a thousand dollars.

The health costs are incredibly high. Do you suppose some of the reason is, like the story of the man who would not buy insurance for his family and Medicaid paid for the obstetric services, costs have to be recouped in some fashion? In a way, it is their own redistribution of wealth, I guess.
Yes. All medical services are paid for, whether paid for the recipient that doesn’t pay or everyone else actually paying for their medical care. The cost of providing medical care to those who don’t pay is rolled over to the bill given to those who actually pay.
Also, there is no effective oversight. For some reason, the government wants to ake over full control of health care when it isn’t even able to provide oversight of it.

Thanks to our education system, it is very difficult to reach young people. Over the course of decades, both parents working, more and more power taken away from parents in children’s eyes, they have been left to learn from wrong ideologies. It is a very difficult situation. This is just the tip of the iceberg. More and more of the cost will end up being funded by State coffers and before all is said and done you’ll be lucky to keep enough of your paycheck to keep a roof over your head and food on the table. Now-a-days it is expected that parents pay for their kids college education. When you have college students applauding because they can stay on mom and dads insurance until they are damned near 30 years old. Those who serve in the military, are in college getting degrees in the hard sciences, engineering, medical fields, or those youngsters who learn a trade, plumbing, tool and die, machinist, all skills desperately needed by American businesses are to be commended. I’m hoping they’re studying something useful in the economy, like engineering or science. The last thing we need is more political science (i.e. fraudulent history) or fine arts majors. Those subjects are worthless in the economy.
If you study economics and (actual) history, the political “science” will fall out as a spillover effect.
Fine arts is a good subject to be familliar with during a discussion at a social soiree, and that’s about it.
There isn’t a shortage of jobs in this country. There is a shortage of qualified people to fill them. The more people that qualify themselves for these jobs, the greater the effect of spillover jobs being created will be.
The more people that have to be supported by the people who qualified themselves for these jobs, the greater the effect will be fewer people choosing to make the sacrifices to qualify for these high paying jobs because they won’t be getting that much more than someone who plays basketball at midnight every night.
