12 Days of Solutions, Day 7: Repeal Obamacare

As Washington continues the debate over how many of your taxes to raise and how little spending to cut, the Affordable Care Act continues its seemingly inevitable move towards full implementation. Even with states nullifying the law’s exchanges, other things are settling into place, including hundreds of billions of dollars in tax increases.
This is totally unacceptable to Tea Party Patriots, which is why Congress should include repeal of Obamacare as an amendment to any “fiscal cliff” deal.
Of course, Members of Congress will argue this isn’t possible – the law was passed almost three years ago, after all. Here are a few reasons they should stiffen their spines:
- The American people oppose the law, and have since before it passed.
- The law raises over $700 billion in taxes.
- It violates conscience rights.
- It violates the right to not participate in economic activity.
- Its price controls will harm seniors.
- It double-counts Medicare cuts as “savings” and spending.
- It will reduce economic activity, further injuring our economy.
In the end, Obamacare isn’t just about tax and spending increases. It’s not just about price controls. It’s about all of these, as well as the will of the people. Tea Party-minded Members of Congress should include repeal of Obamacare as part of any deal on the fiscal cliff.
This is an atrocity and must be repealed. I refuse to participate.

Yes under that program company paid health insurance will be considered income to the employee.
Why donn’t we hear people saying “Obama Tax” like it actually is?
The bottom line is, those who sacrificed and worked every day of their lives to earn the living standard they have are going to pay for those who never sacrificed and worked every day to have an equal living standard. In short, today it is half the country paying for everyone. Anything you subsidize will grow. It won’t be too long before there will be more moochers than providers. An idiot can see this. And they expect the eocnomy to continually grow while the percentage of moochers on the economy grows. … idiocy.

I haven’t heard this one before;

Could you explain how this would work? I appears to me that 35 million people going to the doctor who weren’t before would increase economic activity at least for doctors, hospitals, drug companies and so on.
If 35 million people went to the mall and didn’t pay for anything, economic activity would not increase. In fact, the increased activity on a finite set of human assets by people not paying for anything will cause those who are paying to receive less because you can’t just go to Ben Bernanke and tell him to print up some counterfeit time.
Those not paying now will continue to not pay. Those paying now will have to not only continue paying for what those not paying are currently receiving, they will have to pay for the increase in medical assets those consuming but not paying will be given.
If Ben Bernanke could counterfeit medical assets like he counterfeits money, then there is a chance that there will not be a reduction in the amount of health care available to those who pay.
This is Marxism. The population of the United States would realize that if they had not been dumbed down so far they can’t even define “Marxism”.

Governments are not efficient economic actors. Whenever they take money out of the productive economy, whether by taxation, regulation or mandate, even if they happen by chance to return it to some productive use, they waste far too much of it in their bureaucracies.
If government economic planning and government participation in the economy was correct and efficient, the U.S.S.R. would have quickly become the economic powerhouse of the world, instead of impoverishing it’s country and it’s people.
Well let me give you some basic information. Medicaid pays 18 cents on the dollar. Simple way to put it is like this you own a store in which you sell a can of coke for 1. 00 the government comes in and tells you they want to buy your coke but will only pay you 20 cents per can. Now the coke cost you 50 per can. As a store owner you must figure out a way to get the government to pay you at least 50 per can or your going to loose a lot of money. Now you can not just raise the price to the government only so you must raise the price for the coke to everyone to 2.50 per can. Now can you sell it at that price not likely. Doctors and hospitals have been forced to raise there rates in order to break even with the services provided to those currently using government insurance. Many of these hospitals and doctors will be out of business but that is a different issue.
A case in point, my wife had surgery to repair a tendon in the palm of her hand in an outpatient medical center. She was in the center approximately 3 hours total. They billed the insurance company 25,000 dollars, in addition to the couple of thousand dollars we paid.
Another case in point, I ate some bad food in a Casino in Biloxi and went to the emergency room, thinking I was having a heart attack. I spent 2 hours total there. They made recordings from sensors attacked to my thorax, and then did a sonic scal for gall stones. I received an injection for discomfort. They billed my insurance company 8,000 dollars.
I think we need two medical systems. One for people that pay, and one for people that don’t pay. Neither system is obligated to provide services to members of the other, casess of severe injuries requiring emergency medical treatment excepted. And, the government is required to pay the full rate when the case is a moocher’s life is saved in a hospital where people who pay for their medical care go.
The problem is, we are paying not only for our own medical care, but for the medical care of people who don’t pay. Compounding this, there is no oversight. What does the Surgeon General really do for a living? If we didn’t have to pay for a whole horde of people consuming but not paying, medical costs would be significantly less for those actually paying. Some EFFECTIVE oversight would help, also. And, not the kind of oversight we had with Chritopher Dodd and Barney Frank overseeing the banks and financial services. That will end in disaster, just like what the Democrats did to the economy, and the Republicans gave it to them in negotiations.
That is Obamacare. Making everyone pay instead of you and me paying for the “moochers”.
Crusty, already 47 % of American households are considered by the government to be too “poor” to be required to pay income tax. Only an ignorant fool thinks the Democrats are going to start making that base for them pay taxes. The other half of the country that pays all the income tax for the entire population will also be forces to pay the penalty Justice Roberts ludicrously calls a “tax”. The bottom line is, half the country will continue to pay no additional taxes, while the other half paying all the taxes will have to pay more.
That has to change. We need a flat tax with no exemptions and no excuses.

The last chance to repeal ObamaCare ended with the re-election of Obama and a Democrat majority Senate on November 6th. To continue and push the notion that ObamaCare can somehow be repealed at this point does nothing but build false hope with members. The best that can be hoped for at this point is to effect some minor tweaks to its implementation and maybe to rescind some of the more absurd parts of the law. However, wholesale repeal is now a dead issue with the results of the election. We may not like that fact, but we have to deal with it.

Once it gets in place it will be like Social Security: impossible to get rid of.
The Democrts want a catastrophe. They will use any catastrophe as justification for the government to take control of everything and institute an all-powerful government, and make all Americans subjects.

I don’t see Obama trading away ObamaCare as part of any fiscal cliff negotiations. So far he has refused to put anything real on the table in terms of spending cuts, so I doubt he would put his prize accomplishment on the table.
I agree with you completely. Once ObamaCare implementation starts, it will be virtually impossible to stop. That is backed up by history on virtually every major entitlement started in the last 100 years.
BTW, I see a lot of talk about impeachment being thrown around as a way to get rid of either members of Congress or the Supreme Court. I’m chalking this up to shear frustration over the situation we face as opposed to being a viable solution being proposed. After all. even if you could get the House to impeach any of the individuals being discussed, no one on the Democrat side in the Senate would go along with any of this. Since Democrats control the Senate, that would effectively neutralize the purpose of the impeachment process. No one would be removed from any of the positions being discussed. Thus making impeachment a non-starter so to speak.
I also see there are some comments about Constitutional amendments being discussed. Do we really want to afford an opportunity to Obama and the Democrats to further erode what little safeguards still exist in the Constitution? You know Obama and the Democrats will only go along with the amendment process, if they think they can insert language that will give the government even more control over our lives.
Paul, I believe we should not negotiate with the Democrats on the constitutional amendment issue. You are correct. Their intent is to make the Constitution null and void. Any input from them will be as a result of that intent.
We will probably have to push with a Constitutional Convention and get the two-thirds ratification without Congress. The bottom line is, when two-thirds of the states ratify an Amendment, it becomes part of the Constitution.
Then, the next step is to get the government to abide by the Constitution. That has been a dismal failure lately.

If we don’t get help, we won’t stop just because of that.
The truth is, all of us that are 50 years old and older won’t be able to stop the Democrats’ intent to install a totalitarian government. Those kids that are in their 20s, 30s and 40s will either resist it and maintain our constitutional democracy, or give it up.
How well did we train the generation that will follow us? It’s too late to start. They either are, or are not going to defend the Constitution and the United States from the tyrants trying to seize control.
It will be a long time before the Court’s are done trying to decide just how unconstitutional Obamacare is, in how many different ways.
If we somehow manage to escape total economic collapse and tyranny, there will have been so many bad effects from Obamacare before the next election cycle that the “progressives” will get thrown on the ash heap of history, where they belong.

I blame that traitor John G. Roberts. I can’t believe he sided with the socialist and ruled ObamaCare constitutional. If you look up RINO in the dictionary there is a picture of John G. Roberts.

This is beyond socialism. ObamaKare is Marxism. It’s nothing less than taking wealth from people who worked and earned it and giving it to people who chose to not earn what they demand everyone else pay for.
If the penalty is a tax, then half the population will pay this tax for themselves as well as the other half. If half the population is already too poor to pay income tax, it’s a no-brainer they won’t be paying the Obama Tax. We’ll have to pay it for them.
That makes ObamaKare a bill of attainder. Unconstitutional on those grounds, also.
It is unconstitutional for the government to require anyone to pay a penalty/tax merely because they are exercising the constitutionally guaranteed right to life. ObamaKare is unconstitutional on those grounds, also.

After we fix Congress, we’re going to have to fix the Supreme Court, also. To start with, we only need 5 justices.
DB – How can we change the Supreme Court? I agree we need to get rid of all the Liberal justices but not sure about changing the Constitution.
Any Supreme Court justice can be removed by Congress.
And, we need to change the Constitution back to 5 judges, the way it was before FDR stacked the court by changing the number from 5 to 9. Since FDR stacked the court, the rulings have been nothing short of insane.

The number of Justices has varied during the history of the Supreme Court. FDR only threatened get his tame Congress to raise it to 15- it didn’t actually happen, nor did it need to. The mere threat was enough to get the Court to reconsider all the New Deal programs they’d ruled unconstitutional, and decide that the commerce clause and the general Welfare clause could be stretched to include almost anything.

@DBWriter: The “penalty” built in to ObamaCare is not a tax – it is a penalty that will be assessed to anyone who does not pay the tax, and the tax is the cost of buying healthcare. Something that hasn’t been mentioned to us yet by Barry, or anyone in Congress or the MSM, is that with any tax the IRS deems that we owe, we pay a penalty if the payment is late, and if we don’t pay at all then penalty charges keep adding up until we DO pay the full tax amount owed. There’s no way of getting around that with any tax owed. I believe that anyone thinking they can get out of ObamaCare by simply paying a penalty are in for a rude awakening.
I too blame that modern day Benedict Arnold John Roberts. What a dirty rotten scoundrel, a Bush appointee who stabbed all of us conservatives in the back! I will never forget that smug in your face smile Roberts had on June 28th, 2012.
I don’t know it it will ever get it’s day in court, but Robert’s, in my opinion, completely killed Obamacare.
By ruling that failure to buy health insurance as mandated by the law will result in a “tax” being levied on the individual who doesn’t comply, the Supreme Court made it possible to actually do what the law says anyway, that is, not buy insurance without incurring any penalty.
The reason is that a tax on an individual who doesn’t purchase health insurance will be a Direct tax in the Constitutional sense. Since Direct taxes are not legal unless they are apportioned, if they levy a tax on me because I don’t buy insurance, they have to levy the same tax on everyone, and that just won’t happen.
Craig, what disturbs me is 47 percent of households in the United States are already so “poor” they can’t pay income tax. There is no way they are going to be forced to pay the Obama Tax. Those that are paying everyone’s taxes already will be paying the so-called “tax” for Obama’s pipedream.

The second biggest killer in the United States is medical mistakes. Perhaps we should give the Surgeon General some responsibility, like overseeing the medical industry.

Evelyn, when you pray for someone, you pray for them to do the will of God.
I doubt the will of God is being done in the White House. It needs a lot of prayer.
But, perhaps we have, as a society, become so self-centered in the past half centure, we need to be taught a lesson. Obama and the Democrats fully intend to institute a totalitarian government and make the population subjects, as if we’re serfs bound to the land.
Had we defended our Constitution and liberties when their assault began to succeed about 40 years ago, we may have not needed this lesson.

We need to rid ourselves of all of them and take back the Senate and keep the House in 2014. Problems will be solved if Justice is served to those guilty in our government for breaking the law. Very simple! If they ignore the United States Constitution, steal from the American people and do nothing to protect and save our military/US ambassadors then they are to be held accountable. None of them are above the Law! It is all about Right from Wrong. Evilness and Corruption has taken over our government and there will be some brave soul(s) to fight it and expose it all. Obama care or by anyother name is TAXATION “WITHOUT” REPRESENTATION. The last time this was tried the “TEA” was overthrown. Simply tossed overboard into the sea. Right now the sea is the people of this nation with the very significant feelings that we are drowning, litterly. The representatives and senators work for us, but are tone deaf to the will of the people. Somehow these representatives. etc continue to be re-elected. Only a few seem to have any backbone to stand up for us. Their reward, is to be punished by being cut from assigned commities. I wish to God what can we do besides telling one another our problems or e-mailing represenatives and senators with our complaints. I’m not so sure these people even get our message(s). I often fear that they are just read by assistants and the writer is sent a “form” thank you. That’s sure a warm fuzzy feeling.
