but for the first time in my life I’m truly afraid. It seems to me that Romney and the Republicans have a problem answering
health care questions because of Romney Care. Why can’t they all explain it this way, and keep repeating it as the Dems do.
Mass. Has 6 million people to cover. The federal govt. will have over 300 million to take care of under this cumbersome act.
The 10th amendment gave this right to the people of Mass. The feds could never handle the problems of All 50 states.

Jefferson said that the only rightful remedy for the unconstitutional acts of the Federal Government is for the sovereign States to nullify that law, thus making it of no effect in that State.

Wow. Now I remember why I’m a democrat. I’ve never heard such hate mongering in all my life and it’s really sad. Some people just don’t want to accept the fact that the President IS legit, is a citizen and for those of you who are racist, you need to remember he’s also 1/2 white. It seems that with all the problems Americans are facing, citizens would choose to pull together to try and get through this instead of allowing racism and misinformation to run rampant.
Yep, I’m voting for him – I figure it’s a win-win situation. If he wins, then I’m happy and I think the country will continue to improve. If Romney wins, well then, I suppose bluebirds will immediately start singing, the sun will always shine, flowers will continuously bloom, the rich corporations will decide to get off their wallet and choose to increase their workforce and forgo continuing huge profits by paying less workers to do more, the economy will be back on track within 6 months (I’ll give him that long though I’m sure he won’t need it), private health care companyies will offer citizens health care at a price that is affordable and has adequate coverage, our environment will continue to replinish itself as we continue to take and take from it (because that’s the way it’s supposed to be) and our children and grandchildren will still be able to enjoy nature …even if it is oily shores and depleted forests, and the world will respect us again because we tell them they have to.

Cynthia, I don’t think impeaching Obama is a practical idea or even a good one at this point, since the election is closely approaching; it would be easier to just vote him out of office. However, I have entertained the thought of implementing legal measures to impeach the chief justice and liberal justices who voted to uphold Obamacare. Perhaps, after the Republicans regain the Senate and presidency, our next focus should be on judicial impeachment as an incentive for the judiciary to make their rulings in accordance with the Constitution. With such a threat of impeachment, subsequent rulings on similar legislation pertinent to Obamacare as a tax may even be struck down. The effort that you have and are putting forth to preserve liberty is greatly appreciated. But the time has come for the states to step forward now and “Nullify” this law. Waiting until 2014 for the states to take specific action is too late. We can’t play by the Socialist/(aka Communist) game plan. Both political parties (Democrat and Republican) have put “We the People” at this perilous crossroads. That WWII Navy veteran that called in gets my praise. I know that my late father also a Navy WWII veteran and my uncles were not fighting for a socialist/communist form of government and loss of liberty for their children and future generations. We now have a form of dictatorship in place and let’s be truthful that’s what it is and millions of Americans and veterans are coming to that conclusion. Cynthia – The system is so corrupt that no impeachment could succeed. Every single member of government needs to be replaced. Yes we might lose a few good ones like Rep. Bachmann but it would still be worth it as the corruption runs that deep.
Term limits are more effective than impeachment, very short term limits, two terms for House, one term for Senate, one term for President.

My uncle was a chief and bombadier in the navy during WWII. He was killed over the S. Pacific on 8/8/45. My other 2 uncles and my dad were all injured during the war. You are correct they did not fight and sacrifice so much for socialism and for what is going on in this country right now. It is up to all of us now to turn this around. This is the most important election of our lifetime. When the Japanese bombed Pearl Harbor, our parents and grandparents got motivated and acted. Now it is up to us to preserve what they fought for. The liberal media and politicians think the tea party has died out. We need to get noticed again. The march in DC put the politicians on notice that we were serious. The liberal media attention was negative but it worried them. I think we need another march to let them know again how we feel. Unfortunately, I live in a liberal state that will do nothing to negate this obamacare. I can not afford to move until I retire in a few years. I will then move out of this corrupt state. My health insurance has gone up $150 in the last 2 years. I am self employed and own a very small business. I can not afford more. I will be lucky if I am still in business if Obama gets re-elected.

Again “Conservatives,” it was your guys, the Heritage Foundation, who came up with this backwardsassed free market “solution,” that you guys call “Obamacare.”
There has been a lot of misinformation shared on this call.
1. The law does not end Medicare or call for giving seniors aspirin instead of care.
2. The electronic medical records provision doesn’t create a system where the federal government prescribes care. This is a wild distortion of the funding the law provides so doctors and healthcare providers can eliminate waste and duplication in record-keeping and to reduce treatment errors. It has absolutely nothing to do with prescribing a particular set of treatments.
3. The health insurance exchanges that will be set up in every state, either by the state or the federal government if the state chooses not to set it up itself, are just online marketplaces where people can buy insurance. They will be like the insurance websites that exist now for car insurance: private insurers will compete for your business there. They are not some kind of sinister plot: they’re designed to use the free market system to lower the cost of insurance for people who don’t buy it through their employers and who are purchasing it now in the individual market.
Does this energize us to fix the wrongfull supreme court?
Kagan must be impeached! She perjured herself in front of the Senate! She is a communist and Islamophile! She should have recused herself from the Obamacare case!! She was deeply involved from the Whitehouse!!

My suggestion is that the Tea Party publish some basic information to distribute that shows all costs and “taxes” in this legislation that will affect people including, but not limited to the so-called mandate.
My comment is that when I remember Nancy Pelosi saying we have to pass this to find out what’s in it, I think that is, at best, an irresponsible statement.

There were so many incorrect and misleading messages in this Town Hall meeting, which I attended, that I feel compelled to respond.
1. The Affordable Care Act doesn’t end any Medicare benefits to seniors. It actually strengthens seniors’ purchasing power through lowering the cost of prescription drugs, with a $250 rebate in 2010 and, beginning in 2011, providing a 50% discount on name-brand prescription drugs this year. By 2020, the federal government will provide a 75% discount on name-brand and generic prescription drugs. It’s absolutely shameful and irresponsible of Congresswoman Bachmann to tell the sick, elderly woman who called that President Obama thinks Medicare should just send her home to take an aspirin.
If you don’t believe me, the non-partisan fact-checker, Factcheck.org, notes “There’s even a section in the new law (section 3601) that says: ‘Nothing in the provisions of, or amendments made by, this Act shall result in a reduction of guaranteed benefits under title XVIII of the Social Security Act (the title that establishes the Medicare program).’” (http://www.factcheck.org/2010/07/mayberry-misleads-on-medicare/)
2. Congresswoman Bachmann told people on the town hall call that the electronic records provision of the law will be a means for the government to dictate to doctors how a patient must be treated. This is categorically false. The law does not set up a system in which the federal government will in any way control the way a doctor treats a patient. The purpose of the electronic records Congresswoman Bachmann referred to is just to make care more efficient, to eliminate waste and duplication, and to help coordinate care among treating physicians. Doctors purchase software for this purpose from private vendors (it’s actually created jobs) and the federal government is not involved in this process except to provide money to make it possible.
I think maybe Congresswoman Bachmann might be conflating the law’s support for electronic medical records with a completely different provision of the law, the Medicare Independent Payment Review Board, which is in no way related to electronic medical records. The purpose of the IPRB is to bring medical professionals and other healthcare experts together to determine how to reduce the growth of Medicare spending. But, according to Factcheck.org, “the law explicitly says that the IPAB’s proposals ‘shall not include any recommendation to ration health care, raise revenues or Medicare beneficiary premiums … increase Medicare beneficiary costsharing (including deductibles, coinsurance, and copayments), or otherwise restrict benefits or modify eligibility criteria.’” (http://www.factcheck.org/2012/04/death-panels-redux/)
So nor only does this board have nothing to do with dictating to doctors what they can and can’t do, it only advises Medicare.
Bottom line: there is no federal entity under the law that will dictate to doctors what kinds of treatments they can provide to their patients.

3. A caller from Florida, then Congresswoman Bachmann and another guest lauded Rick Scott for refusing to set up the state’s insurance exchanges. I don’t know why anyone wouldn’t think it was a good idea to set up online marketplaces that allow people who need to purchase coverage in the individual insurance market to compare policies and choose the one that’s best for them, but that’s what the exchanges are for.
In any case, the law provides states with millions of dollars to get these set up the way they think best meets their needs, as long as the policies meet the baseline standards for coverage. But if the states decide they don’t want to set them up themselves, the law calls for the federal government to set it up for them.
Why would a state refuse to set it up? And why would you waste your energy fighting against online marketplaces that will help people buy less expensive insurance coverage if they can’t get it from their employers, especially when it will allow them to enter a bigger insurance pool than they can participate in now without purchasing through an employer?
5. Why would you not want to cover 16,000,000 people with incomes under $29,327 for a family of four by expanding Medicaid? The law provides federal funding to states for 100% of the cost of providing this care between 2014 and 2016. After that, the federal share will very slowly decline until it reaches 90% in 2020. Who would be covered? Parents and childless adults who aren’t already covered and are struggling to meet their healthcare needs– often in emergency rooms, requiring everyone with insurance to pay more because of the extra cost of treating the uninsured in emergency rooms.
6. Congresswoman Bachmann got it wrong when she said the law would cover millions of illegals. Even she admitted that the law explicitly says it doesn’t cover illegals, who are not eligible for the sliding scale of subsidies the law will provide to families earning between $33,075 and $88,200 for a family of four to purchase insurance. And even if they could pay the whole amount, illegals will not be able to buy insurance on the exchanges.
Still, Ms. Bachmann insisted that the Affordable Care Act will in some way be responsible for providing medical care for illegals. Fact: the reason illegals are treated in our hospitals now and have been for years is because of the law, passed during the Reagan administration, requiring emergency rooms to treat anyone who comes to them for help. It has nothing to do with the Affordable Care Act.
7. Congresswoman Bachmann stated unequivocally that employers would drop their insurance because of the Affordable Care Act. A lot of experts have studied this issue, and many have concluded that large employers will have little reason to drop coverage and small employers who don’t currently offer it will have incentives to do so because of tax credits that are available through the law.
It doesn’t do any good to incite fear about the Affordable Care Act based on misinformation and misunderstanding. I recommend the timeline on the government’s official website, http://www.healthcare.gov/law/timeline/, so you can see when all the provisions of the law take effect. Perhaps you’ll be reassured that the law isn’t all that you fear, and you might discover some components of it– like the factsheet on preventive care tests and screenings that are or will be covered by insurers with no co-pay.
Keep in mind that the healthcare reform law has been debated for about three years, now, and nearly every public statement about it (pro and con) has been reviewed by independent, non-partisan fact-checkers. Obamacare: It’s the TAXES, stupid!
The 16th amendment seems to contradict the original intent of the constitution to levy non-progressive taxes (ones that are apportioned equally and fairly based on population). It said that a progressive tax (based on how much you make) was legal.
It did not appear to remove the original statement in article 1 section 9. Thus it appears there is a contradiction in the taxing authority of the constitution. One says direct taxes are legal only if they are apportioned. The 16th amendment says non-apportioned taxes are also legal.
My question is why does the legal community not see this as a contradiction? How could the supreme court under Wilson’s administration not reject the 16th amendment simply on these grounds?
If the answer is because the amendment supersedes Article 1 Section 9; then how can justice Roberts make a case for direct and apportioned taxation if the words of the constitution that justifies it are nullified by the 16th amendment?
But if the 16th amendment did not nullify Article 1 Section 9 Paragraph 4, then both statements are contradictory! If the court accepts them as valid, then they are asserting a tautology: That enumerated powers = the power to tax everything because everything can be taxed.
The principle of freedom of the individual suggests that the entity that exists to guarantee individual freedoms can’t also take away individual freedoms!!!
Taxes are a tool for enslaving otherwise free individuals who committed no crime. I think this topic was debated hotly by the founders and in the federalist papers. Some argued at the constitutional conventions that Article 1 Section 9 paragraph 4 should not have been included. I believe it was included based on the argument (fear) that nobody would pay anything to support of the federal government. This seems like a misplaced fear given the many who were willing to take up arms against imperial England or would serve in elected positions in the government, that at the time received no payment — they were truly giving a service.
It seems the best way to ensure individual liberty and freedom is to remove the enslaving grip of taxation of the citizenry and rely on the good will of the people to sacrifice some of their substance (monetary, time, or property) as they see fit; as donations-in-kind to support the government and the charge it is under by the constitution. If the direction of the various branches of government deviate from this charge in any meaningful measure, the people will immediately ‘vote’ with their pocket book. There will result in motivating public servants to make needed course corrections quickly.
Those who oppose extending this degree of individual freedom and responsibility are unenlightened as to the true nature of people and the providence of God in instilling a testimony of duty to care for the general welfare of the people and the government. There is no power of government that supersedes the power of divine conviction and this is the power upon which the constitution rests.

The right way forward is to not only repeal the 16th amendment, but also to strike paragraph 4 in Article 1 Section 9 from the constitution.
