Cornyn on Obamacare: Repeal and Replace

In the wake of the Supreme Court’s decision to uphold The Patient Protection and Affordable Care Act (PPACA) known as Obamacare, Senator John Cornyn, R-TX, is ready to go full throttle down the Road to Repeal of this legislation.
Speaking to listeners of Austin’s KLBJ 590 morning radio show Friday morning, Cornyn said, “We’ve got to repeal it and replace it with a patient-centered bill, not a government takeover.”
Senator Cornyn has opposed this legislation since its passage. In February of this year, he and 42 other Senators filed a brief with the Supreme Court in support of the multi-state, bipartisan suit filed to challenge Obamacare. The brief stated in part, “… Congress acted without constitutional authority in enacting the individual mandate of the PPACA. In so doing it has damaged Congress’ institutional legitimacy and has triggered severe conflicts between state and federal governments that the Constitution was carefully designed to avert. [Our] interest, therefore, is in preventing the long-term damage to our form of government that will result from the nature of the PPACA.”
The Tea Party Patriots national organization opposes the bill, stating on its website that “The Supreme Court Ruled Against the American People. It’s time for the People to take action.” Senator Cornyn concurs. “It will take We the People in November to go to the ballot box. We need the public highly energized to vote,” Cornyn said this morning. He was disappointed by Chief Justice John Roberts’ ruling, and declared that if the people take action in November, in January the Senate could use the budget reconciliation process to eliminate the tax.
Obamacare has its strong defenders and opponents. The Democratic congressional campaign committee website has a brief outline of what the Supreme Court’s Decision Means:
- Children no longer being denied coverage due to pre-existing conditions (pg. 23)
- Seniors paying less for prescription drugs
- Students and young adults staying on their parents’ plans
- Being a woman is no longer a pre-existing medical condition
- Insurance companies no longer placing a lifetime limit on coverage (pg. 13)
- Small businesses receiving tax credits if they choose to offer coverage to employees (pg 120)
The Galen Institute lists their most fiscally irresponsible items in Obama care:
- employer mandate to provide health insurance or face fines (pg. 126)
- religious organizations required to provide free services even if they violate their religious beliefs (pg. 178
- Twenty new taxes on medical equipment, health insurance, home sales, etc. for a total of $500 billion (pgs. 730, 735, 736, 739, 741, 749, 752, 753, 754, 764)
- Medicare providers will see $575 billion in payment reductions
- Huge deficits – the CBO has raised its cost estimate for the law to $1.76 trillion over ten years
- At least 159 new government agencies, boards and programs will be implemented, all of which will need taxpayer funding (pgs. 69, 247, 321, 327, 372- 389, 387, 471, 609, 668, 672, 714, 726, 788, 861)
Neither website posts supporting details for their claims; relative page numbers from this reporter’s search of the bill are listed next to each item. It should be noted that the mention of the small business tax credit on the DCCC list does not refer to the fact that they must qualify and are subject to a phase out of this credit based on average wages.
That Obamacare is a tax is now official, as is the fact of its trillion dollar price tag. The question remaining is how the American people will respond in November, and if the bill remains intact how America will pay for it.

We should have congress repeal the law that Reagan inacted forcing hospitals to treat all people regardless of their ability to pay, after all our federal taxes pay 50% of their losses, and the hospitals regain the other 50% by overcharging insurance companies. After 9/11 it was necessary to pass the Patriot Act so that our law enforcement could access information that has helped them find, arrest and prosecute would be terrorists. I agree that there are way too many people on Medicare and Medicaid – young people who are very capable of working. I agree there are folks out there using as many Free Benefits as they can get and I believe with all my heart, they should be made to work if they are fully able to do so. Tell you a little story my mother in law told me..it is True. She said in her younger days, if you got food stamps, Medicare, etc. – they made you go work somewhere as a Volunteer for so many hours a week, and that paid for your few Benefits that you got back then. Maybe that’s not a bad idea for today’s society…volunteer to do free work for your benefits. { NOW, I’m not talking about the disabled or the elderly.} I’m strictly talking about these ones who can work But will not.
You figure if they got to volunteer to work for free – maybe as a janitor at a hospital or some company, just to get those benefits, then they may as well get a Real Job that pays Money and either get them off these benefits completely or else reduce them some.

I have been around this world for 73 years and have never seen people dying in the streets. How stupid is that statement. My daughter is a nurse and people who cannot afford to pay are treated. BTW, insurance companies are not charities. They are in business to make a profit. The doctor is not a charity, they are paid. Health care is not a right. If it is, show me in the constitution. This country has gone wild. Everyone thinks it is all free. Get your heads out of your butts and do some research. The money comes from those of us who work and pay our taxes. I think you have your ducks in the row. I started working when i was big enough to push a broom and my sis and i would go to Dad’s work and sweep up that old oil dry, put in a dust pan and put it in a barrel. So I know what work is like. BTW: Dad paid us out of his pocket and we’d get to go to the movies…think it cost $.50 to get in and a quarter or so for pop corn and about the same for a coke.
So Yes, I certainly agree with you. There are too many people who will not work and by the same token there are those who are truly Unable to work.

Hospitals along the Texas Mexico border were closed because accident victims from Mexico were transported to Texas to receive free medical care. Most of the illegal aliens that have been flooding the country are uninsured and simply refuse to pay for hospital visits. That’s one of the major cost factors of health care; it’s also one of the reasons the Democrats refuse to close the borders. It added to the crisis in medical care that allowed them to con the public into supporting this idiotic health care act. So now we have more taxes, higher medical costs and poorer medical care.
The way to cut costs is to increase the number of doctors and nurses and hospitals. We should also have tort reform so we don’t have so many frivolous lawsuits over health care. All they do is make the lawyers rich. The liberals have blocked tort reform every time it’s proposed.
The insurance companies are not innocent in this health care debacle. Their lobbyists (K St. law firms) were authors of large parts of this law. The underhanded deal they made with Congress was that Congress would force people who pay for their medical coverage out of pockiet would be forced to pay huge premiums to the insurance companies, while still paying for their medical esxpenses (like prescription eyeglasses and dental care) out of their own pocket.. This bill was a money grab by the insurance companies and a power grab by an aggressive liberal government. Pelosi and other Democrats simply told the big lie that most of these people were freeloading; that is a big lie!!

Businesses have been able to deduct insurance premiums for decades! What’s new are over a thousand big businesses that have been given specific exemptions by president big ears, so that they DO NOT HAVE TO GIVE THEIR EMPLYEES HEALTH CARE COVERAGE despite the law. This health care bill is ONE HUGE SCAM RUN BY CONGRESS AND THE INSURANCE COMPANIES!
One of the lies Pelosi and the liberals used to pass this bill is that uninsured people are freeloading on those who buy insurance. Many of the uninsured pay for their health care out of their own pocket. This bill is a way to force people to pay premiums to insurance campanies, while still paying for their health care, such as dental work and prescription eye glasses, out of their own pocket.

If our government wants to mandate healthcare for all, let them clean up thier house, tighten thier belts, stop all the waist, and fund it themselves. Why has our government become so bloated and complicated that 90% of us who fund it, have no idea where our money being used or abused? Why is it only when our government slips and corruption is found out that any sort of investigation is implemented. Of course only to be dismissed and ignored, and it’s on to the next one. Nothing ever seems to be resolved or corrected. They simply rewrite some laws to allow thier transgression against the ones who are supporting them. It’s all comming to a head as it did some 236 years ago. Enough of us are “fed” up with the business as usual crowd, to try and do something about it. Our government, created to unify us has divided us. There are those who agree with the way things are being done and the ones who do not. Race has nothing to do with either, citizenship does however. Niether of the two are happy with the way it has been run, and each blames the other for the problems. How will anything change using this model? We have run away spending and the more it’s attempted to rectify the allocations the faster the spending becomes. Simply attempting to document where the money has gone has been made impossible and no one person, agency, system, or program can perform the task. How can we allow our country to run like a runaway freight train and just oil the occasional bearing once in a while, hoping we won’t derail in our lifetime? I contend, that is is entirely possible that if we were to be able to bring this country’s government under control, document all the spending, we’d find all the necessary money we needed for healthcare and many other social welfare programs.

I’m sure we all appreciate the Senator’s enthusiasm, but pulling a quote from the article above and the brief he filed, I think it’s only fair to point out that SCOTUS, the final arbiter, has decided that the Senator and the other Senators were mistaken. Congress actually did act with constitutional authority. So, the premise of his argument is flawed, rendering the rest of his argument meaningless.

To cure our deficit we should: 1. repeal bush tax cuts. 2. Creat new tax to cover senior prescription drug that bush started but did not pay for. 3. Create new tax to pay for Iraq war fought under misinformation. Our deficit is political not economic.
I am actually surprised that the governor of the Republic of Texas didn’t call the White House immediately after the Supreme Court ruling concerning Obamacare-tax and subsequently secede from the Union.
All kidding aside, ladies and gentlemen of the left or the right, it comes down to common sense. The reason why I bring this up is simple. We are a people that are not used to being ruled. Why? We have elections, and yes I agree that the mainstream media pushes elections one way or the other, I get that, but when is it going to be too much and the system finally breaks? What then? I’ll tell you. It will be self imposed anarchy and all because we as a whole have drifted so far from reality that we (left or right) will be made to suffer and fend for ourselves.
You can only tax the people so much before the people hit their breaking point. How many times in the recent past have we suffered due to ill advised legislation in order to attain votes and retain power with those individuals whom power is absolutely everything?
During the recent economic recession, for example, I never received food stamps, unemployment, or any form of entitlement. When I came home from my second tour of duty in Iraq, I found myself unemployed, but I didn’t quit and sucumb to my fears. I got my ass out of the house, pounded the pavement, and got another job. I showed up every day to a job that paid me little, and I was always on time, no matter what. I eventually, and still during economic recession, ended up with my dream job. My point is is that no matter how bad things get, I didn’t need the gov’t to do it for me and I don’t need them to do it for me in the future. I was raised in abject poverty and I know what it’s like to live in houses (if you can call a shack a house) with no toilet. As a child, I know what it’s like to see my folks use foodstamps to pay for groceries. If I can resolve to better myself, and provide for my family, no matter what lay before me, then those that are career welfare recipients for no other reason than they just don’t want to work, can and should do the same. There’s a difference between lazy and needy. That particular line has been blurred and it sickens me everyday.
As far as the Supreme Court ruling, I believe that I should not have to pay for someone else’s medical care. If you are on welfare and have the ability to go out into the world and be productive, you should be made to do so. If you’re disabled then you should be taken care of. It really is that simple. There are crops to be picked, farms to maintain, and McDonald’s is always hiring, but you have to start somewhere. I did.
It’s time to stop making excuses for the lazy entitlement recipients (and I really don’t care what color your skin is) and kick their asses off that couch and out of that home (that I paid for by the way) and be made to work and pay their fair share of taxes.
That’s how simple the solution really is.
Also, no more illegal immigration. I shouldn’t be made to pay for that either. Put up a fence that extends below ground so they can’t tunnel beneath it and mine it on either side. I’m sick and tired of seeing violent crime rates go up everytime the drug cartels send their thugs over here on our soil. Gang and drug related violence has gone up exponentially due to the fact that we won’t protect our own borders.

As you surely know, every european nation has a insurance system, ruled by the state and free companies to ensure that everybody get medical aid. I have to admit, that long time I could not imagine, that the worldwide economical leading USA do not have an medical aid. So here I have some questions, and i would really appreciate your help for understanding the actual debate in your country:
-How did the medical system work before Obama?
-Why did the Democrats want to change something?
-Why did the Republicans stay with the old system?
-What has a insurance to do with “european socialism”?
-What are you afraid of, when you see the actual european medical policy?

Everyone gets medical care now; everyone has been getting medical care for years. People come here from Canada to get medical care that is unavailable in their socialist system. People from Mexico come here to get FREE mediacal care they can’t get in Mexico. Obama care is a scam intended to force people to pay money to insurance companies and the Federal government. Many of us who are uninsured pay for ALL of our medical care out of our own pockets. We will still have to pay for medical care out of our own pockets after paying the government and insurance companies!

Well, but how would you see a system in which you pay a fixed fee to an insurance company (or a federal organization) and therefore you never have to pay therapies or any other medical care. The money would directly go from the company to the physicist. In my point of view it is easier to handle fixed costs every month than pay suddenly high amounts. Hm, maybe the crucial point is to obligate people to enter this system, but on the other side it could have big personal advantages.

The problem I and many people have with Obamacare-tax is that it is just that, a tax. Why should I pay into a system of health care that benefits those that don’t want to provide it for themselves.
Let’s be real about something, when the Supreme Court Justice ruled it a tax it brought the whole house down. By that I mean, there are no personal advantages to a gov’t run program that is sure to become a beauracracy and a bloated one at that.
The lines will be so long the list will stretch for long amounts of linear time measured in months. No one will get in to see the doc in time to receive decent medical care. The care will be meted out and it won’t go to the elderly like those on the left claim, or to the disadvantaged (those that really need it such as the disabled) it is going to become a bloated behemoth that will never work. However, they won’t get rid of it when it fails because then, the gov’t would have to admit failure. To do so, even for the liberal left, would be like shoving a sharp stick in their eye, willingly.
Let’s face it, it won’t work the way it is intended. No gov’t program ever does. That’s why we have porous borders, a welfare system that has fostered several generations of people on gov’t assistance (that should be made to work if they are able), and a two party system that isn’t working. Not that it can’t, but literally won’t.
I don’t like being taxed for something that I don’t want to buy. I don’t like paying for welfare for individuals who can work but won’t, and I don’t like having to bend to the wishes of the obviously clear minority.
