“Activist-in-Chief” Warns Supreme Court Against “Judicial Activism”

President Obama issued what many commentators are calling a “threat” to the Supreme Court – to not declare his unconstitutional Obamacare law unconstitutional.
The President warned it “would be an unprecedented, extraordinary step” of “judicial activism” for “an unelected group of people” (the Supreme Court) to overturn Obamacare – which, the President said, was passed by a “strong majority.”
None of this is true. And all of it is unbecoming of a President of the United States.
First; the President’s so-called “strong majority.” Mr. Obama did have a strong majority of Democrats in Congress when Obamacare came to a vote. But his unconstitutional health care power-grab was so despised by the American people that the President had a hard time getting his own Democratic majority in Congress to support it. That was when the secret deals and backroom bargains began.
The “Stupak 7,” a group of “pro-life” Democrats, were coaxed into supporting Obamacare with a promise that no federal funds would “cover any part of the costs of any health plan that includes coverage of abortion.” The President broke that promise after he got the 7 Democratic votes he needed to (barely) pass Obamacare. And then there was the “cornhusker kickback” for Democratic Senator Ben Nelson, which led Justice Scalia to quip last week: “the Cornhusker kickback, okay, we find that to violate the constitutional proscription of venality.”
Outside of Congress, Obamacare has never enjoyed a “strong majority” of support from the American people. From day one, the American people were skeptical about this unconstitutional overreach of government power. In the two-plus years since the Bill was introduced, the Tea Party Patriots led the charge against Obamacare – and now the majority of the American people are with us in saying that Obamacare is unconstitutional, and that it must be fully repealed now.
We are the “strong majority:” We the People who believe in a Constitutionally-limited government.
It is not “judicial activism” for Supreme Court Justices, who swear oaths to uphold the Constitution, to uphold the Constitution. But it is the worst kind of activism for the President of the United States, who also swore an oath to uphold the Constitution, to force an unconstitutional law on the American people – against their will – and then tell the Supreme Court to violate their oaths and support his unconstitutional law.
We, the Tea Party Patriots, believe what America’s Founding Fathers believed: that the power of government is to be limited by the Constitution, and by a series of checks and balances on government power that our Framers set forth. When We the People speak, our voices should be carried by our elected representatives, not bought off and silenced by secret, backroom deals. When the Supreme Court honors its oath to uphold the Constitution, our President should not insult them at the State of the Union Address, or threaten them from the White House bully pulpit as he did this week.
We, the Tea Party Patriots, have led the charge against Obamacare, and we are in the majority when we say “Repeal Obamacare, all of it, now.” Instead of concentrating more power in Washington with this unpopular, unconstitutional law, respect the Constitution and its framers and return power where it belongs: to the people, and to the states in which we live.
Our nation’s founding document – the Declaration of Independence – declared the self-evident truth that first among our unalienable rights are life and liberty. That is what we demand: liberty over our lives, which means liberty over our health.
The Supreme Court has a sworn duty to “support and defend the Constitution of the United States against all enemies, foreign and domestic.” We ask each member of the Supreme Court to honor their sworn oaths, to ignore the rants of the executive branch, and to declare the unconstitutional Obamacare law unconstitutional.

As a former member of the United States military, I am more than offended that you use such terms of disrespect for our acting commander-in-chief. Maybe you are not familiar with the proper etiquette of respect, but I suspect that the problem here is based in the fact that you feel President Obama does not deserve any respect because as a black man, he is less of a person than yourself, which is very sad. I support your right to speak freely, I just wish that as leaders of a group that is advocating change you would find a way to set a better example for those who would look to you for guidance.
Of course you would turn this into a race issue when it is clearly not. Use your head, and maybe try to understand what you are reading next time. This message is a challenge to an atrocious idea, not to a man’s skin color.
Is the race card is the ONLY card you have? Try sticking to the Constitutional issues.
If you can’t speak intelligently, pull the race card. Look at the promises, then look at the actions. No similarity at all. Besides, he’s only half black, and has not 1 thing in common with the American black family. yet the “chickens are supporting Colenel Sanders”

Playing the race card? Really? Respect is not giving, it is earned… and so far, Obama has done nothing to earn my respect. I’ll have you know that both my parents, one of my grandparents, and multiple uncles are all veterans, and I don’t think any of them would agree with you. The fact that Obama is black doesn’t make a difference; I would’ve happily supported Herman Cain had he secured the Republican nomination (though I’m really pushing for Ron Paul). The fact that Obama is pushing for unconstitutional, socialist policies in our democratic country is what bothers me. That fact that, as the leader of a leading world power, he had the nerve to lie right to the face of the American people and say that this was passed by a vast majority bothers me. The fact that he is criticizing the Supreme Court for upholding the Constitution bother me. Not race. Uninformed reasoning like yours, Bert, is why Obama was elected in the first place. You sound like the kind of person who would applaud Nancy Pelosi’s “We’ll just have to pass the bill to figure out what’s in it!” comment. I would think that someone like you, who faught for a free country, would be against this digusting display of socialism known as Obamacare… but you have the right to disagree and I thank you for your service to our country.

As with any job, the person elected or hired should have the qualifications necessary to do the job …not just be a particular gender or color or race.
I believe the current President has not been qualified for this very important position of leadership. Many of his actions have been embarrassing to the USA.
There are several Senators and Representatives who do not have the good of the country at heart either.
Bert; no one here disrespects the office of President. We as a Tea Party will make are collective voices heard in November and take the necessary steps to take back America from the worst President in America’s history. Have a happy Easter and God bless. Bert, first thank you for serving our country and fighting for freedom and liberty for all. Now, please recognize that Obama is the enemy of the very freedom you were willing to die to protect. His POLICIES are VERY BAD for the USA and his tactics are nothing short of Chicago-style POLITICAL BULLYING. Obama, as President of this great country, should be ashamed to try to intimidate the Supreme Court into supporting this unpopular, worst of all, health care boondoggles. It IS unconstitutional and nothing but a grab for control over health care, one of FIVE MAJOR segments of the economy. Freeing up regulations to allow Insurance companies to write policies across state lines, leading to competition in a free market, would be the better first step toward lowering costs, avoiding rationing, and protecting our liberties. There are other much more sane solutions to health care that would be better. The first step any dictator takes to destroy a country is to control the monetary system and as much of the private sector as possible. The bigger government gets, the more power it accrues to itself, and the greater the erosion of all our liberties. Opposing Obama is a NO-BRAINER! We must for the sake of our freedom. Can anyone still support him when, thinking his microphone was off, he indicated to the Russians that if he gets elected again it will be his last term and he will have much greater freedom to offer them dear knows what!!!! (What other secret deals is he planning with other foreign powers if he gets re-elected????!!! Don’t forget he sold our long term ally, Brittain’s national security secrets to the Russians already in order to broker a deal with them. He is one scary dude!!!!) Please remember that it is our fault that this man is president. We did not do enough to stop this disaster. I believe his intentions are good but the dictator like approach and the “blame game” shows he is way in over his head. He is simply the worst president of our time. It wouldn’t matter if he were black, white, or made of gold. However Bert, I do agree we should respect the position of Commander in Chief. When it comes down to it, this is still the greatest country on planet earth! I hope we, as a nation, can band together get through the next few years. Unfortunately, the true damage this president has done probably won’t be revealed until after the election.

Wow. Someone can’t even state the truth without being accused of disrespect. I could see it if he resorted to name-calling and the usual tactics of the left to discredit a President. But the truth is offensive and disrespectful, and that deserves using the race card? Man, that’s deep. What would you call telling the Supreme Court they better not declare unconstitutional a program which is unconstitutional?
Further, there is no respect for a man sworn to uphold the constitution, yet does his best to ignore it.
What did the legendary Ronald Reagan do when he shipped arms to Iran ?
While people working under Reagan were involved with this issue, Ronald Reagan himself denied knowledge of the unconstitutional series of events during the Iran-Contra Affair, yet, being the man he was, took responsibility for it. I think that his legacy as a great man and a great president alone is enough to tell you that he was telling the truth. This is far different from Obamacare. Not only is Obama aware that the Constitution is being violated, he supports it! It can’t be long before he starts pushing for amendments that impede on our beloved freedoms in the very document that’s meant to protect them!

But he spent our tax dollars to build a mosque in NY near ground zero, and in Pa near the crash of flight 93. Nothing but new taxes, loss of liberty, and the greatest insult to injury, denial to access of health care for the people who need it the most. Our seniors, our parents and grandparents in some cases. The people who have contributed to this country all their lives. What’s not to love?

When the Presidents policies and comments come straight from his activist roots handbook I think “Activist-in-Chief” is a very appropriate title. And as for Mr. Bert, as a former member of the United States Military I would think that you would be appalled at the actions of the “Commander-in-Chiefs” administration slipping vital military secrets as to plans to thwart action against an Iranian nuclear program that not only threatens our allies in the middle east but has the potential to further threaten the stability of all of our efforts (which includes our boys blood) to bring freedom to that region of the world. Matt, John, Pearl, Michael,Mike and all the rest who feel the same way you all do. I first of all thank Bert for his service. I also understand his feelings about how disrespected he must feel. Like it or not, Mr. Obama is the commander in chief of our armed forces, and THE PRESIDENT. As such he deserves our respect. As a soldier, you are taught to follow orders. You don’t get the opportunity to choose which ones you follow because you don’t happen to be in agreement with the commander that issued them. You also don’t get the opportunity to call the president the “Activist-in-Chief”. This is not about black white or polka dotted, it is about the office of the president of the United States. Respect. Because of people like Bert, we can sit here and write comments like these. We may not like the proposed legislation, but fellow tea partiers, may I ask each one of you this question… Like it or not, we have a health care system here in America that is BROKEN (yes I said BROKEN) Have you offered an alternative to “Obama care” ? or are you just content to bitch ? It is our right, as the American people, to disagree with the president and protest his decisions. It is his job as the president to respect our wishes and uphold the Constitution. Since he hasn’t done either, why should we just give him respect? Do I respect him as a person? Yes, Obama and his wife seem like nice people. Yet, as a politician, I don’t feel he deserves any respect. As for proposing alternatives to health care, multiple tea partiers, both in the video and online HAVE proposed free market solutions. Though, whether our solutions get used or not, unconstitutional legislation is NOT the way to go… especially when the tax payer have to pay for it.
I am doing a report on this article for class and part of my study was to write down the facts and opinions of an article. I could only find opinions in this article which is very sad. Perhaps i missed some details however the extent of your accusations could be judged differently by people with other opinions. There are no definite, solid facts.
Of course he knew nothing. When ever it is convienient to one side’s viewpoint there can never be wrongdoing. Republicans who worship at the tomb of Reagan and Democrats who worship at the tomb of Roosevelt; 2 people from opposite ends of the spectrum. Each felt they did the best thing for the country. Both patriots, both dedicated to their principals. Would either of them call the other an “Activist-in-Chief” ? How about showing respect for the office of the Presidency. If you don’t like President Obamma, PRAY FOR HIM !
What alternative has the Republican party offered as an alternative to Obamma care? Our current system is BROKEN too many people can’t afford medical care and dental and optical care is even harder to afford. “Romney Care” is criticized as the blueprint for Obamma care. Repeal Obamma care yes, but lets propose an alternative America deserves that.
You would have had to been paying attention to understand the Republican’s proposal. The President offered a summit in Pennsylvania where concerned elected Republicans offered up many ideas. None of them were considered. As to your point about people affording medical care, premiums and helath care costs have risen.
Ummm. THe current system referred to as Obama care is essentially Rommney care as offered up by the GOP after the Clinton plan was defeated. PA Republicans solution as put by Tom Corbett is to “just close your eyes”
I believe people in every position of society need to ask themselves “What’s more important – The Presidency or the Constitution and then act/vote/behave accordingly.

This query is a bit short of the subject in discussion, but, according to Mr. J. Carter, one can choose to not serve rather than serve and submit, and even be pardoned for same, no? The ramifications of this postulate are prickly, to be sure. Respect for a President is not a requirement for an active duty serviceman; however, a vow of loyalty is required. But remember, a President is not a King. The President works for all, not a select few. As do the other 2 branches of government.

Yes, he’s a black man…we get it. But it only stands to weaken your statement when that’s the only reason you choose to try and defend this issue. Wake up…that excuse is simply not going to fly with trying to guilt people into buying his agenda.
His agenda is what this issue is all about. The Unconstitutional make up of “Obamacare”. Not his race. Obamacare will find ill effects on all Americans, regardless of anyone’s race. The bill was pushed through at a time when it was relatively easier to do so. But America woke up and decided that this is not Constitutional on many levels. That’s why it’s before the Supreme Court.
Obama is angry because he is not getting everything that he wants. Many psycologists would say that most narcissists tend to react this way.
You mentioned “respect” for the Commander-in-Chief which has little to do with this particular issue. I am a United States Military combat veteran myself, but I am not trying to use that as leverage to make a point. Millions of Americans share the same patronage. However, he would be better suited as Commander-in-Chief if he acted more like it.
What is shameful, is that this Commander-in-Chief is stooping to
strong arm tactics by chiding the Supreme Court and warning them from the White House. Warning them of what?? Warning them that they should not make a decision based on the Constitution?
Not altogether very inspiring for someone who is sworn to uphold the Constitution, which applies to all that are serving and who have taken that oath. I would be willing to bet that he absolutely would not be able to remember or repeat the oath of office, word for word, even to this day.
As a retired Judge who was never a “judicial activist”, I’d remind you folks that our settled law is that courts – both state and federal – must exercise restraint in reviewing challenges to the constitutionality of legislative actions. That has been the essence of the conservative position as advanced by the Federalist Society and other conservative legal organizations for years. We now – for the first time in my 68 year old life – have a truly activist USSC which stands ready, without much hesitation, to rule unconstitutional statutes they simply do not like.
This is a dangerous course, and one that will discredit our judicial system for years to come.

The Judiciary is one of three branches of government. Do you believe that judges should not be paid by government? Or that the parties to each case should pay to have a Judge?
Does the fact that someone has served as a state or federal judge disqualify him from being able to formulate positions and express ideas?
How about retired military personnel? State or federal law enforcement officers? Firefighters? They’ve all had their salaries paid by taxpayers.
Social Security: ie- Medicare, Medicaid, SCHIP, DOD TRICARE, VHA…anyone ever hear of any of these. Everyone seems to be retorting such hot words as “Socialist Healthcare” without realizing healthcare has been “Socialist” for 50+ years. Right there in the name> “Social security”. How does no one notice this? These above programs cover more than 30% of the US population. And how many hard working Americans will elect to defer their medical, government funded paid by their taxes medical, payments when it is their time to use these programs?? Am I the only one allowed to Google this or something? Duh.
And think of the extent of medical advances in the late 1700′s when the constitution was written. And dental? Removing teeth with string tied to doors? For christsake, slavery was still legal when it was written! 100 years before the lightbulb was invented… We, as americans, truly feel that every word still applies? Really? There are such things as amendments, you know. They tried the same stunt on FDR in ’37. Your parents and grandparents would have been cold and dead by the age of 55-60 max if that didn’t pass. You preach “fiscally responsible” but you can’t perform simple math to see how much our tax dollars are bleeding right now on this issue? It’s those who refuse to pay for health issurance who end up “cashing in” later-by getting sick and refusing to just die already- YOU, the irresponsible ones, are the targets of this bill. Pay up, for yourselves. Obama is just trying to make it hard for you to not be covered. You are the true damage to the treasury, WHEN you get sick. If you think you’ll live to be 90 with no health problem, and then just die peacefully and cost-efficiently in your sleep, then go for it. Otherwise, shut up and pay for your damn self already. The reason govt has to force you is because you refused to for too long, and it’s costing us all money. Consider this someone finally holding your hand and telling you to look both way while crossing the street of life, because apparently you couldn’t do it yourselves. You’re welcome.
